Terms of sale
Last updated: [date]
These terms apply to every purchase made on this website by [legal name] ("the seller" or "the artist"): the digital products (the ebook and the video course, sections 1 to 7) and the custom artworks ("commissions", section 8).
This text is a template to be checked by a legal professional before launch. Information in [brackets] must be completed.
1. Products
- Ebook — "How to succeed on social media as an "artist"", a PDF file.
- Course — "Traditional drawing, from scratch", a set of streaming video lessons and downloadable resources.
Descriptions and prices are shown on each product page. Prices are in euros, all taxes included [or: VAT not applicable, art. 293 B of the French CGI].
2. Order and payment
Payment is made online by card through Stripe. The order is confirmed once the payment is accepted. A confirmation email with an access link is then sent to the address given at checkout.
3. Access and delivery
Access is immediate after payment, from the "My library" area, by logging in with the email used for the purchase (magic link, no password).
- The ebook can be downloaded at any time, without time limit.
- The course is available for streaming for the lifetime of the course, including lessons added later.
4. Right of withdrawal
In accordance with article L221-28 13° of the French Consumer Code, the right of withdrawal does not apply to digital content supplied immediately after purchase when the buyer has expressly agreed to the immediate start of access and waived their right of withdrawal. This agreement is collected by a checkbox before payment.
5. Refunds
Because access is immediate, purchases are non-refundable except [describe your policy, e.g. "if the file is defective and we cannot fix it within 7 days"]. Contact [email] for any problem.
6. Licence and personal use
The products are licensed for personal use only. You may not share, resell, upload, redistribute, record or publicly display the ebook or the videos, nor share your account access. Each copy may be personalised with the buyer's email to prevent sharing. Any breach may lead to the access being revoked without refund.
7. Liability
The advice in the products is based on the author's experience and does not guarantee any specific result (followers, income…).
8. Commissions (custom artworks)
8.1 How an order works
1. The client chooses an offer and its options on the commissions page and sends a request with a description of the work and reference images. The price shown is calculated by the website from the published prices; it is recalculated on our side and is the only price that counts. 2. Some offers need the artist's acceptance first ("request" offers): the artist accepts or declines the request, possibly with a note. Other offers can be ordered and paid immediately ("instant" offers). 3. Once accepted, the client has a limited time to pay, shown on the order page and in the email ([72] hours by default). Without payment in that time, the request expires and the slot is released, with nothing charged. 4. The order is confirmed when the payment is received. Its progress (queue, sketch, colours, delivery) can be followed at any time in the "My account" area, which also holds the messages with the artist.
8.2 Price, deposit and balance
Prices are in euros, all taxes included [or: VAT not applicable, art. 293 B of the French CGI]. Depending on the offer, the client pays either the full price at once, or a deposit (percentage shown before payment) then the balance when the artwork is finished and before the final files are delivered. Shipping costs for physical originals are shown before payment. A tip can be added; it is optional and non-refundable.
8.3 Turnaround
Turnaround times are indicative estimates, shown in days from the start of the work, and depend on the queue. The "Express" option, when offered, shortens the estimate. The artist informs the client through the order page of any significant delay.
8.4 Revisions
The number of revisions included in each offer is shown on the offer page. Revisions are made at the sketch stage. Extra revisions, or major changes requested after the sketch has been approved, may be charged at the price shown, after the client agrees.
8.5 Cancellation and refunds
- By the client, before the artist accepts or before payment: the request can be cancelled at any time from the order page; nothing is charged.
- By the client, after payment and before the sketch is shared: full refund [minus non-refundable payment fees — to validate].
- After the client approves the sketch: the work already done is due, so the deposit (or the amount corresponding to the work done) is not refunded.
- By the artist, for any reason, before delivery: the client is refunded in full for any amount paid for work not delivered.
Refunds are made to the payment method used, through Stripe, usually within 5 to 10 days.
8.6 Right of withdrawal
A commission is an artwork made to the client's specifications and clearly personalised. In accordance with article L221-28 3° of the French Consumer Code (and 13° for the digital files supplied once the work has started with the client's express agreement), the right of withdrawal does not apply. The client acknowledges this by ticking a box before sending the request. The cancellation conditions of section 8.5 still apply.
8.7 Delivery and validation
Digital artworks are delivered as files to download from the order page (high-definition files are available once the order is fully paid). The client has [7] days to confirm the delivery or report a problem; without an answer within that time, the order is considered completed.
Physical originals (traditional artworks) are shipped to the address given by the client, by the carrier and with the tracking shown on the order page. Risks pass to the client upon delivery by the carrier. In case of loss or damage during transport, the artist helps the client claim compensation from the carrier [and insurance option, if offered].
8.8 Copyright and licence
The artist keeps all the copyright (author's rights) on the artworks. The client receives a non-exclusive licence to use the artwork:
- Personal use (included): profile pictures, personal posts with credit to the artist, personal prints. No resale, no merchandise, no advertising, no use to train AI models.
- Commercial use (only with the "commercial licence" option): the uses described on the offer page, for the client's own project, with credit to the artist where possible.
Unless the client chose a private commission (or "public after a date"), the artist may publish the artwork in the artist's portfolio and on social media, and show it as an example of the artist's work. Character designs and the client's own intellectual property remain the client's.
8.9 Content
The artist may decline any request, in particular for the subjects listed in "I won't draw" on the commissions page. The client guarantees they hold the rights to the references they send.
9. Personal data
See the privacy policy.
10. Disputes
These terms are governed by French law. In case of dispute, the buyer may use a consumer mediator free of charge: [mediator name and website]. The EU online dispute resolution platform is available at https://ec.europa.eu/consumers/odr.
